What is Medical Negligence?
Medical negligence occurs when treatment falls below the standard expected of a reasonably competent healthcare professional, causing you harm that could have been avoided.
This may involve errors in diagnosis, surgery, prescriptions, or emergency care. Our role is to investigate what went wrong, build a strong case using expert evidence, and fight to recover compensation for your pain, suffering, and financial losses.

Types of Medical Negligence We Can Help With
Birth Injuries & Pregnancy Care
Pregnancy and childbirth should be a joyful experience, but mistakes in maternity care can have life-changing consequences. Medical negligence during pregnancy, labour, or delivery can result in harm to both mother and baby.
Examples include:
- Failure to monitor the baby’s heart rate during labour.
- Delayed response to signs of foetal distress.
- Errors in the use of forceps or vacuum delivery.
- Failure to recognise and manage complications such as pre-eclampsia.
In some cases, these mistakes can lead to conditions such as cerebral palsy, physical disabilities, or long-term developmental issues. At MMC Legal, we work with independent medical experts to assess the care provided and to help families secure the support and compensation needed for the future.
Surgical Errors
Surgery carries inherent risks, but patients are entitled to expect that procedures are carried out with skill and care. Unfortunately, errors during operations or in post-surgical care can result in avoidable suffering.
This may include:
- Wrong-site surgery or procedures performed incorrectly.
- Instruments or surgical materials left inside the body.
- Infections due to poor hygiene standards.
- Inadequate follow-up care leading to complications.
If surgery has left you with unexpected harm, we can investigate whether negligence occurred and help you seek redress.
Misdiagnosis & Delayed Diagnosis
Early and accurate diagnosis is often crucial to successful treatment. When conditions are missed or misdiagnosed, patients may suffer unnecessary progression of illness or even reduced life expectancy.
Common examples include:
- Failure to diagnose cancer at an early stage.
- Misdiagnosis of fractures, infections, or heart conditions.
- Delayed referrals to specialists.
- Incorrect reassurance that symptoms are harmless.
A misdiagnosis can not only worsen health outcomes but also lead to emotional distress and financial losses. We help patients hold providers accountable and seek compensation for the harm caused.
Medication & Prescription Errors
Errors with medication can have serious consequences. Patients trust healthcare professionals to prescribe, dispense, and administer drugs safely, but mistakes happen.
Examples include:
- Being prescribed the wrong medication.
- Incorrect dosage instructions.
- Failure to review harmful drug interactions.
- Administration errors in hospital or care settings.
Such mistakes can cause anything from short-term illness to severe, lasting harm. If you’ve suffered because of a medication error, our team can help.
Accident & Emergency (A&E) Claims
A&E departments are busy and fast-paced, but that does not excuse avoidable mistakes. Negligence in emergency settings can have devastating consequences.
Examples include:
- Failure to recognise life-threatening symptoms (such as stroke, sepsis, or heart attack).
- Incorrect treatment or delays in treatment.
- Failure to order or correctly interpret X-rays, scans, or blood tests.
- Discharging patients too early without proper assessment.
If you believe your care in an emergency department was negligent, MMC Legal can provide advice and pursue your claim.
Dental Negligence
Dental treatment, whether routine or cosmetic, requires precision and professionalism. When mistakes are made, they can cause pain, financial loss, and sometimes long-term damage. Examples of dental negligence include:
- Extraction of the wrong tooth.
- Nerve damage during procedures.
- Misdiagnosis of gum disease or oral cancer.
- Poorly performed cosmetic dental work.
Compensation may be available for both the pain caused and the cost of corrective treatment.

Time Limits – Don’t Delay
In most cases, you must begin your medical negligence claim within three years of the incident that caused your injury. However, sometimes patients are not immediately aware that their treatment was negligent. In those situations, the three-year time limit may start from the date you first realised, or reasonably should have realised, that negligence had occurred.
For children, the rules are different. Where the negligence happened while you were under 18, the time limit normally extends until your 21st birthday to bring court proceedings.
Frequently asked questions
You might have questions about the process, your rights, or how we can help.
That’s why we’ve put together this FAQ section to answer the most common concerns and make everything as clear and straightforward as possible.
How do I know if I have a medical negligence claim?
If your treatment fell below the standard that would reasonably be expected of a competent healthcare professional, and this caused you harm, you may have a claim. The best way to find out is to speak to one of our solicitors for a free consultation.
How long will my case take?
Medical negligence cases are complex and can take time because of the need for detailed expert medical evidence. Some claims may resolve within 12–18 months, while others take longer. We will keep you updated throughout.
How much will it cost me to make a claim?
We will discuss funding options with you at the outset. In many cases, legal aid may be available.
In the event that you do not qualify for Legal Aid, you should make enquiries with your Home Insurers to find out if you have Legal Expenses Cover to fund the cost of bringing your claim. Your Solicitor can help you and make enquiries on your behalf.
We can also advise on other ways to protect you from financial risk.
Will making a claim affect my ongoing medical care?
No. You have the right to pursue compensation if you have been harmed by negligence. Making a claim will not affect your entitlement to receive care within the NHS or private healthcare system.
Will I have to go to court?
The majority of cases are settled through negotiations. However, if a court appearance is required, we will guide you through the process.
